H-1B Temporary Worker - Specialty Occupation Vias

The H-1B visa is an employment based visa in the United States that permits certain types of qualified foreign workers to work in specialty occupations for a finite period of time. A "specialty occupation" is one that requires theoretical and practical application of a body of highly specialized knowledge in a field of human endeavor such as architecture, engineering, biotechnology, medicine, theology, accounting, etc. An employer must be the sponsor for such workers and their employment is limited to the sponsoring employer. There are laws limiting the number of workers in this category, but significant exceptions are provided to allow certain types of skills greater access to U.S. opportunities.

A Dallas immigration attorney practicing in Dallas, Fort Worth, Denton and Tyler can help you sort through the massive amount of legislation and determine how to proceed to lawfully procure the skilled workers you need. Although an H-1B worker may initially have only one sponsoring employer, that employer may elect to place the worker in another position of employment at a different worksite and with a different employer, but only if applicable rules are followed.  H-1B workers may have more than one employer only if a petition is filed and approved by each employer.

Counsel to Employers in Dallas, Fort Worth, Denton and Tyler

Immigration laws are some of the most complex laws in this country. They cover all aspects of foreign nationals entering and remaining in this country. Special laws have been enacted to govern the various circumstances under which persons can make a case for their value to this country and thus remain in it. Other laws govern the number of H-1B workers allowed in any given year, length of stay permitted, tax consequences, employer responsibilities and on and on.

Mathur Law Offices can answer your questions; explain the law, advise you about the best procedure to take to successfully hire H-1B employees and what types of situations to expect during this process.  Our knowledge and experience in this area will protect your rights and interests and ensure that you are in full compliance with immigration law.
